Terms of Service

1. Acceptance

By creating an account or using Spec ("the app", "the service"), you agree to these Terms of Service. If you do not agree, do not use Spec.

2. Eligibility

You must be at least 13 years old to use Spec. By using the app you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these terms on your behalf.

Use of Spec on Apple devices is also subject to Apple's Licensed Application End User License Agreement.

3. Your account

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at hello@thespec.app if you suspect unauthorized access.

4. Acceptable use

You agree not to:

• Post content that is illegal, harassing, hateful, defamatory, or that infringes any third-party intellectual property rights
• Impersonate another person or misrepresent your affiliation with any entity
• Scrape, reverse-engineer, or otherwise attempt to extract data from Spec in an automated manner without our written consent
• Use Spec to transmit spam, malware, or any unsolicited commercial communications
• Interfere with or disrupt the integrity or performance of the service

We reserve the right to remove content and suspend or terminate accounts that violate these rules, at our sole discretion.

5. User-generated content

You retain ownership of the content you post on Spec (photos, builds, listings, comments). By posting content, you grant Spec a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content solely for the purpose of operating and promoting the service. You can revoke this license by deleting the content or your account.

You are solely responsible for the content you post. Do not post content you do not have the right to share.

6. Marketplace

Spec provides a peer-to-peer marketplace for buying and selling automotive parts and vehicles. Spec is not a party to any transaction between users. We do not inspect, guarantee, or take responsibility for the accuracy of listings, the condition of items, or the completion of any sale. All transactions are solely between buyer and seller. Use common sense and standard precautions when transacting with strangers online.

7. Intellectual property

The Spec name, logo, and app design are our intellectual property. Nothing in these terms grants you a license to use our branding.

8. Disclaimers

Spec is provided "as is" without warranties of any kind. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of liability

To the maximum extent permitted by law, Spec and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the service. Our total liability for any claim arising from these terms shall not exceed the greater of $100 or the amount you paid us in the 12 months preceding the claim.

10. Termination

You may stop using Spec at any time and delete your account from Settings. We may suspend or terminate your account at any time if we believe you have violated these terms or if we discontinue the service, with or without notice.

11. Changes to these terms

We may update these terms from time to time. Continued use of Spec after changes are posted constitutes acceptance of the updated terms. We will notify you of material changes via in-app notification.

12. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the state or federal courts located in California.
